Fighting back against the “Hate” attack (Liberty Counsel)

Guidestar promotes itself as being “the world’s largest source of information on nonprofit organizations.” They say their data “is at the heart of 60+ websites, programs and applications.” In other words, Guidestar is an international clearinghouse of information on non-profit organizations. So when Guidestar attached the Southern Poverty Law Center’s “hate group” designation to Liberty Counsel’s information on their website, their intention was obvious. GuideStar used the SPLC’s label to cause financial harm to Liberty Counsel and 40 other non-profit organizations.

Last month, a federal judge in Virginia dismissed Guidestar’s reckless and damaging use of the “hate group” label against Liberty Counsel. But that ruling was based on an incorrect view of the law and the allegations pled in the suit. When GuideStar placed the “hate group” label on Liberty Counsel, the same page solicited financial payments for GuideStar membership.

The judge’s decision means organizations like GuideStar may be further emboldened to target and label Christians and Christian organizations with the “hate” label without fear of repercussions!

This week, Liberty Counsel filed an appeal challenging the district court’s dismissal of our lawsuit against GuideStar. The lawsuit reiterates that GuideStar violated the federal Lanham Act, along with state law violations of Interference with Business Expectancy and Defamation.

The narrow issue on appeal is whether republication of the so-called “hate group” label is “commercial speech.” Liberty Counsel believes that it is. GuideStar used the false and harmful “hate group” label to cause us financial harm while promoting its own commercial interests.

With more anti-faith “hate group” attacks expected to follow, along with a caseload that is already stretching our resources, we must EXPAND our legal resources right away.

The first five weeks of the new year have left us in a serious budgetary SHORTFALL!

Thankfully, a friend of this ministry has issued a $50,000 Challenge Grant — but we must match this generous commitment dollar-for-dollar to maximize this Challenge and meet our goal. And on top of this Challenge Grant, we recently received word that an additional $25,000 Challenge Grant has been pledged – but we must raise the amount in order to receive the grant. Please help us raise $75,000 to match these grants!
